<title>Major Social Security Changes Coming</title>

<description><![CDATA[<p><span style="font-family: Arial;"><span style="font-size: 12px;">Late on December 20th the US Senate passed the Social Security Fairness Act. This law repeals the Windfall Elimination Provision and the Government Pension Offset. This bill was already approved by the House of Representatives. The bill is certain to be signed by President Biden.<span style="color: #3e3e3e;"></span></span></span></p> <p><span style="font-family: Arial; font-size: 12px;">The two repealed provisions impacted the Social Security benefits earned by many Michigan public employees.</span></p> <p><span style="font-family: Arial; font-size: 12px;">Implementation of the changes will be in the hands of the Social Security Administration. <description><![CDATA[<p><span style="font-size: 12pt; font-family: Arial, sans-serif;">As many of you know, MAPERS worked with legislators and other&nbsp;groups to repeal the pension tax placed on your&nbsp;retirements several years ago.&nbsp; As a result of our efforts, the Governor signed Michigan Public Act 4 of 2023 (“PA 4”) which <span style="color: #353535;">phased in an income tax reduction for retirees over the course of four years, beginning with the 2023 tax year (filed in 2024). <title>Governor Whitmer Signs Executive Order Protecting Workers Who Handle FOIA Requests</title>

<description><![CDATA[<p style="text-align: left;"><strong>LANSING, Mich.</strong> — Governor Gretchen Whitmer today signed Executive Order 2020-38, which relaxes requirements for responding to FOIA requests made by mail or fax during the COVID-19 emergency. This action will protect workers who handle FOIA requests by allowing public bodies to defer portions of requests that would require workers to report to work in-person. The Executive Order takes effect immediately and ends at 11:59 p.m. on June 4, 2020.<br />
</p>
<p style="text-align: left;"><span>“During a time of crisis, it’s crucial that Michiganders have access to the information they need to stay safe. My administration is committed to ensuring that while also protecting public health and encouraging social distancing,” <strong><span>Governor Whitmer said</span></strong>. “This Executive Order encourages public bodies to respond to Freedom of Information Act requests in a timely manner and in the safest way possible.”</span></p>
<p style="text-align: left;"><span>Under the Executive Order, a public body must respond to a request received at its physical office via U.S. mail or fax within 10 business days after an employee receives and views the request. <p style="text-align: left;"><span>The Executive Order also requires public bodies to communicate in writing with the person filing the request if they are unable to fulfill the request without a search of physical public records. The person filing the request then has the option to amend their request to include electronic records only. If a public body is unable to fulfill a request in the timeframe they specified because of remote work and social distancing, then a written notice will be sent to the person filing the request to explain why there is a delay.</span></p>

<title>Whitmer OKs Local Boards, Councils Meeting Electronically </title>

<description><![CDATA[<p><span style="color: #555555;">Local governments and school boards have pleaded with Governor Gretchen Whitmer to give them relief from having to meet in-person during the new coronavirus outbreak, and today Ms. Whitmer signed an executive order allowing them to meet electronically as long as they facilitate public participation.</span></p>
<p><span style="color: #555555;">Under <a href="https://content.govdelivery.com/attachments/MIEOG/2020/03/18/file_attachments/1405067/EO%202020-15%20Emergency%20Order%20-%20OMA.pdf" target="_blank">EO 2020-15</a>, public bodies subject to the Open Meetings Act can use telephone or video conferencing technology to meet and conduct business. There must be a way for members of the body and the public to have two-way communication as well as a public comment period, the order says.</span></p>
